Contractor Delay - Liquidated Damages - Expiring Funds

    A construction task order was awarded with FY19 O&M dollars.  The current contract completion date is in March 2024; however, the planned beneficial occupancy date (date we are anticipating the contractor to complete the work) is November 2024.  Funds will close (expire) on 9/30/2024.  The Government currently stands to assess over $5M in LDs.  The Government is not seeking to terminate at this time, and the preferred course of action would be the contractor to complete the work.

    I believe there was a previous topic regarding allowing a contractor to complete a contract, after funds have closed, through the assessment of the LDs.  If anyone has had a similar situation, or knows where I can find an applicable post, I would be grateful for your thoughts and any information.

    What do you mean by "expire"?

    Do you mean funds that have not yet been obligated?
