Does Trade Agreements Act (TAA) apply to DOE National Lab M&O Contracts?

    Hi all,

    Can anyone tell me why the DOE M&O Contracts for national labs are not covered by the Trade Agreements Act?

    I don't know the official reason, but it makes sense that those contracts are not covered -- indeed, I think it would be impossible to apply TAA to them.

    Do you think they could be covered?  
    Do you think they should be covered?

    @formerfed, the DOE Acquisition Letter site https://www.energy.gov/management/acquisition-letters shows this 2002 Letter as "archived." Is there perhaps now a DEAR regulation? There have been changes over the last 20 years. Wth analysis, maybe it is still good rationale. I could not find what "archived" means.

    @Neil Roberts it’s in DOE Acquisition Guide FY2024 Version 5 part 25.  I found it on my tablet but it locked up before I could copy the reference.
