Non excepted contract and lapse of funds for option period(s)

    If I am reading OMB M-13-22, Attachment 1, II.A., Q&A1 correctly, no action is permitted for non-excepted activities. Several contracts (to which my staff administer) will lapse. Options will not be exercised and there will be delays in the acquisition process for new awards.

    How are other agencies addressing this issue?

    Bilaterally exercise the options and set the effective date for the date the option should have been exercised? Use the ole "mutual agreement of parties" in the "optional fill block on the SF30". I couldn't imagine having to recompete actions solely because the option period lapsed due to a Government shut-down (or was overlooked for a couple of weeks). Talk about a waste of resources. (I know I have no FAR cite supporting my recommendation, so take it as an opinion and not a fact).
