With the President's Removal of DEIA, Do Contract Personnel Need to Take Out Equal Opportunity Clauses?

    My agency is in the process of removing DEIA clauses from our contracts, mainly our agency-specific regulations related to DEIA. With President Trump's EO Ending Illegal Discrimination and Restoring Merit-Based Opportunity rolling back DEIA policies, should clauses like FAR 52.222-26 (Equal Opportunity) and FAR 52.222-35 (Equal Opportunity for Veterans) be taken out of government contracts?

    I assume these clauses are in the FAR so they are still valid.  I would not change your contract(s) until such time as the FAR is changed.  Depending on your agency you may want to reach out to your agency rep on the DARC or CAAC and see what the plan is for these clauses as well as the plan for FAR changes based on other Executive Orders.

    The FAR Councils will have to process proposed & final rules in the Federal Register to change or remove these clauses so I would not do anything now since this regulatory process will take time.

    Makes sense. Thank you! I just got off the phone with my supervisor, and it sounds like we are holding off on making any determination of removing equal opportunity clauses for now. I'm curious to see how this plays out throughout the government since my agency has a lot of contracts that focus on DEIA.
