Scenario: You are going to issue a contract for the overnight, world-wide delivery of toys by a sleigh pulled by reindeer. How do you formulate the contract?

The Contractor shall deliver diversionary contraptions and whirlygigs to locations specified in the Deliver Schedule. Specific items shall be definitized by end user in crayon. Consideration shall be provided in the form of milk and cookies at specified delivery locations.

Just got off the line with Mr. Grinch 'who' agreed with Scrooge. The terms aren't performance based and won't receive clearance approval this year.
Perhaps if we approach it as a supply versus a service and include FOB destination terms we can obscure the worldwide shipping cost and they'll approve.

You do a public interest -7 exception to F&OC -- maybe DHL and FedEx and UPS could do the work, but the public interest is served by letting Santa keep the work regardless of anyone else's capabilities. This is exactly why the -7 exception exists.

Call the toy provider to see if he/she will take an oral contract. If you haven't received the funding from the Comptroller, offer cookies and milk as consideration.

So I just want to know how the heck that there was only coal in my stocking this morning noting especially that the milk (spelled c-r-a-f-t b-e-e-r) and cookies had been consumed? Breach of contract as the delivery was supposed to be only for "toys"?
