Section L and M for Non-Competitive RFP?

    For competitive acquisition, your solicitation has Sections K,L, and M ? which drop off the model contract after award and Section K gets incorporated by reference.

    The question is: For non-competitive acquisitions - new work with J&A approved, does your solicitation still require a Section K and L? From what I can tell in the FAR, the FAR doesn?t make a distinction between competitive and non-competitive acquisitions with regards to Sections K and L, but it isn?t stated explicitly. For some reason, getting advised to remove Section K and L from a RFP. Not sure why really. Was wondering if you any one had an opinion about it or explanation.

    Certifications are required regardless of whether the procurement is competitive or noncompetitive. So Section K is in.

    You need a proposal even though the procurement is noncompetitive. You have to tell the offeror what to put in the proposal and how to format the content, if that matters. So you need a section L.

    I provide the sole source offeror submission instructions in the letter that calls for the proposal. I then draft a contract for award and bypass preparing a solicitation. You are in a sole source situation where hopefully, you are already in discussions with the offeror which precludes formal compliance to a "Section L" as with a competitive acquisition.

    15.002 -- Types of Negotiated Acquisition.

    (a) Sole source acquisitions. When contracting in a sole source environment, the request for proposals (RFP) should be tailored to remove unnecessary information and requirements; e.g., evaluation criteria and voluminous proposal preparation instructions.
