Domestic Nonavailability Determinations (DNADs)

    Does anyone know where there is a list of current DNADs for the Berry Amendment? I downloaded one a few years ago that was current up to 2013, but need to update it. Unfortunately I cannot find one anywhere -- DCMA, DLA, DoD Acquisition and Sustainment, etc.

    I think Congress had the same question.  See H. Rept. 116-120, at 182 ("The committee directs the Assistant Secretary of Defense for Sustainment to provide a briefing to the House Committee on Armed Services not later than December 31, 2019, on the domestic nonavailability waiver process currently used by the Department of Defense.  Such briefing shall include...a list of all domestic nonavailability determinations and national security waivers granted under sections 2533a and 2533b of title 10, United States Code, since January 1, 2014.")

    Any forum members from DCMA or DLA? The list must be out there somewhere.

    I cannot find a current list but everything I find is dated in 2007.

    In accordance with DFARS 225.7002-2(b), the secretaries of the military departments, without power of redelegation have authority to approve DNAD Determination and Findings for their respective requirements. The Under Secretary of Defense for Acquisition, Technology & Logistics serves as the approval authority for the other defense agencies. Each military department has its own procedures for this action and you should contact your Service policy office for guidance.

    It seems each Department has their own procedures and each secretary can approve for themselves.  So I’m guessing no one thought of keeping track at the overall DoD level and make a consolidated list.

    I've attached my latest list, in case it helps identify where it came from. I also see that some were approved by individual agencies (Army, AF), but most were by DLA or USDAT&L.
