Provisions vs Clauses

    Provisions apply to solicitations. Clauses apply to contracts. So clauses shall never be included within solicitations?

    Look up the definitions of provision and clause in the FAR and let us know what you find.

    In addition to Don’s reply, in response to your specific question, read through Subpart 52.1 - “Instructions for Using Provisions and Clauses”.

    For another example, see Subpart 36.5 - “Contract Clauses”. you will see that most of those are prescribed for “solicitations and contracts”.

    And think about it… If you are going to negotiate a contract or otherwise establish a contract price, it requires a mutual understanding of the terms and conditions requirements that will apply to the contract performance.
