What rules would you trash?

    In the spirit of President Obama's review of the rules, http://www.whitehouse.gov/the-press-office...executive-order, what rules in FAR would you get rid of? You cannot chose anything that is expressly required by statute, but you can chose some implementation of statute that is not expressly required. Please provide specific FAR citations for the rules you would trash.

    Any clause that has been made applicable to a contract for commercial items that is not expressly required by statute to be applied to such a contract. FAR 52.204-10, "Reporting Executive Compensation and First Tier Subcontract Awards" is one that leaps to mind.

    The "Rule of Two," FAR 15.502-2(B), so much discussed at Wifcon of late. It is the most anticompetitive rule anyone could come up with and it is not statutory. It goes far beyond any rational requirement of 15 U.S.C. 631(a). It is nothing but a troublesome political sop written by lazy people in OFPP. There must be a better, more rational way to ensure that small businesses get a piece of the action.

    My FAR doesn't have a FAR 15.502-2 ( b ). Perhaps 19.502-2 ( b )?
