FAR 8.002(a)(1)(i) Interpretation

    FAR 8.002(a) states:

    Except as required by 8.003, or as otherwise provided by law, agencies shall satisfy requirements for supplies and services from or through the sources and publications listed below in descending order of priority—

    (1) Supplies.

    (i) Agency inventories;

    (ii) Excess from other agencies (see Subpart 8.1);

    FAR 8.102 states:

    When practicable, agencies must use excess personal property as the first source of supply for agency and cost-reimbursement contractor requirements.

    In light of FAR 8.102, do you think that "Agency inventories" at FAR 8.002(a)(1)(i) means "Excess agency inventories"?

    I think "excess personal property" in 8.102 means both "agency inventories" in 8.002( a )( 1 )( i ) and "excess from other agencies" in 8.002( a )( 1 )( ii ).

    Agency personnel try to use excess personal property before initiating a contract action.

    I don't think "agency inventories" in 8.002( a )( 1 )( i ) means just that -- use you own agency inventories first -- then look at the excess in other agencies -- and all of this before initiating a contract action.

    FAR 8.102 means that if you need a hammer don't buy one if you already have one that you can use.

    Assume you work for DoD and the hammer is in inventory at DLA or a military inventory control point. It is not excess personal property. DoD maintains an inventory of hammers that end users requisition on an as-needed basis. The same hammer is available as excess personal property from GSA.

    Where does FAR 8.002(a)(1) require you to get the hammer? In other words, if you acquired the hammer from DLA or a military inventory control point, would you be acquiring it from "agency inventory" (FAR 8.002(a)(1)(i)) or a "wholesale supply source" (FAR 8.002(a)(1)(v))?

    If you're in agency X and agency X has a hammer in its inventory, you should go get it. That's 8.002( a )( 1 )( i ). You might be able to do this with no requisition, no money, just follow agency procedures and ask for it.

    If your agency X doesn't have a hammer, you should try to get one from another agency's excess -- the other agency isn't supposed to buy products for your agency, but it can give you its excess. That's 8.002( a )( 1 )( ii ).

    If you're in DoD, you might think 8.002( a )( 1 )( i ) is identical to 8.002( a )( 1 )( v ) with regard to military inventory control points, but they might not be -- the military inventory control points might require requisitions and money (or internal budget transactions) -- but for a civilian agency, there is a real difference between ( i ) and ( v ). The FAR is written for both defense and civilian agencies.

    To directly answer your question, I would say acquiring a hammer from DLA or a military inventory control point is from a "wholesale supply source" 8.002(a)(1)(v). Getting the hammer from your squadron's or brigade's or ship's supply locker or other source is 8.002( a )( 1 )( i ).
